DEPARTMENTAL MISSION STATEMENT
The Human Resources (HR) Department partners with Trial Court management to create and maintain a talented, qualified workforce by recruiting a diverse applicant pool, by facilitating the fair merit-based selection for appointment of the most qualified candidates, by developing appropriate workforce training (in consultation with the Trial Court's Judicial Institute), by fostering positive management-employee relations, by promptly addressing workplace issues, and by developing performance based measures to ensure the continued excellence of the workforce. The HR Department will use best practices to ensure that this collaborative effort advances the mission of the Trial Court. The HR Department also provides information and assistance to all Trial Court employees on a variety of work place issues.
Working within the Human Resources Department of the Office of Court Management, the Assistant CHRO for Labor Relations serves as the chief negotiator for all collective bargaining on behalf of the Trial Court. The Assistant CHRO also manages workplace investigations and other inquiries concerning employee conduct and disciplinary matters. The Assistant CHRO is also responsible for maintaining a positive labor relations philosophy that both furthers the Trial Court’s strategic goals, and ensures compliance with the Employer’s obligations under the State’s Collective Bargaining Law. The position supports the priorities of the Chief Human Resources Officer and requires leadership in using both formal and informal methods to address a variety of employment issues and grievances. The Assistant CHRO also manages policies, performs conflict resolution, represents the Trial Court as needed in labor matters, and provides assistance and direction on a variety of other human resources activities.
Receives general direction from the CHRO and Deputy CHRO, performing duties requiring a high degree of independent judgment and initiative.
The Assistant CHRO for Labor Relations is responsible for the following:
Manages the labor relations activities for the Trial Court, building and maintaining an ongoing, professional working relationship between management and the union officials, continually advocating for a collaborative labor environment;
Collaborates with the CHRO and Trial Court Leadership on setting the organizational priorities for collective bargaining agreement negotiations and cost of living increase parameters;
Serves as principal negotiator in Collective Bargaining negotiations;
Leads joint labor-management meetings and negotiations;
Administers all collective bargaining agreements and negotiates all mid cycle joint labor-management agreements and memorandums of understanding;
Supervises the managers and staff within the Labor Relations Unit of the Human Resources Department providing regular guidance, coaching and feedback;
Supervises investigations concerning allegations of workplace misconduct and disciplinary matters;
Provides Department Heads and court officials with best practices by advising and guiding them on the most sensitive and complex of labor relations matters;
Oversees the Labor Relations Unit’s handling of the employee grievance process, including the screening, investigating, and employer responses to grievances;
Works with the CHRO in the development of recommendations for new contract provisions, oversees contract negotiation processes and memorandums of agreement, and identifies strategies for improving the management of the unionized workforce;
Serves as a mediator in dispute-resolution through the negotiation of solutions, which are in the best interests of all parties and in compliance with fair labor practices, bargaining unit contracts and state and federal personnel administration laws;
Informs union officials of serious disciplinary actions taken on union employees in cases of misconduct;
Ensures that the human resources activities that impact union employees are in compliance with the collective bargaining agreements and that new initiatives are implemented in a manner consistent with the employer’s obligations on the State collective bargaining law;
Conducts training sessions as needed for Department Heads and supervisors;
Attends disciplinary hearings as needed;
Responds to inquiries from union officials and court officials concerning the interpretation of language contained in collective bargaining agreements;
Leads special projects; and
Performs related duties as required.
These are the minimum requirements necessary to apply for a position of Assistant CHRO for Labor Relations:
Eight (8) years of labor and employee relations work experience and a Law Degree from an accredited educational institution recognized by the U.S. Department of Education or the Council for Higher Education; or a combination of education and substantial labor relations experience;
Experience as a lead negotiator required. Knowledge of labor relations issues, developing creative and feasible solutions, while interacting effectively and professionally with others;
Significant experience in and demonstrated knowledge of G.L. c. 150E and other state and federal laws that apply to labor relations and human resources issues;
Professional Development: Must have a background that demonstrates a history of regular professional development; demonstrating a record of initiating best practices in labor relations, the consistent application of policies, and innovative approaches to labor relations and conducting employment related investigations.
OTHER POSITION REQUIREMENTS:
Strong interpersonal skills and the ability to work professionally with persons at all levels, including judges, and to maintain effective working relationships;
Demonstrated ability to perform human resources related activities of the most complex and non-routine nature, including researching issues and recommending feasible solutions;
Ability to use personal computers and related business software, including CJIS data systems, an applicant tracking system (Oracle/PeopleSoft) and MS Office;
Ability to understand and administer policies and procedures of the Human Resources Department and the Massachusetts Trial Court;
Ability to multi-task and manage a variety of assignments at once;
Ability to adapt quickly to changing circumstances and develop workarounds for issues that require timely resolution;
Ability to handle sensitive matters on a confidential basis;
Ability to maintain accurate records;
Ability to communicate very clearly and effectively in oral and written form;
Ability to collect and evaluate critical data and evidence in order for it to be organized and presented in a logical manner;
Ability to work independently and with an attention to detail; and
Ability to travel within the Commonwealth as necessary.
